: On the instructions of the JHALSA and under the guidance
of the Justice Commissioner-cum-Chairman, District Legal Services Authority,
Ranchi, a one-day workshop on motor vehicle accidents and insurance claims was
organized in the Conference Hall, 40 Courts Building, Civil Court, Ranchi. The
workshop was inaugurated with the lighting of a lamp. The session was conducted
by DLSA Secretary Ravi Kumar Bhaskar, and the welcome address was given by
Judicial Magistrate Ekta Saxena.
Present on the occasion were Justice Commissioner Anil Kumar Mishra-1, Chief Justice, AJC-15, Amit Shekhar, PO, MACTT, Nishant Kumar, DLSA Secretary Ravi Kumar Bhaskar, Deputy Superintendent of Police (Headquarters-1), Amar Kumar Pandey, Deputy Superintendent of Police (Traffic), Pramod Kumar Keshari, General Secretary, RDBA Ranchi, Sanjay Kumar Vidrohi, and others. The session was conducted by DLSA Secretary Ravi Kumar Bhaskar.
The workshop discussed the provisions and simplification of the process for providing timely and appropriate compensation to the families of motor accident victims. On this occasion, POMACT, citing the changes made to the Jharkhand Motor Accident Laws in 2019 and 2022, stated that the relevant police station must submit information about road accidents to the tribunal within 48 hours. He further stated that accidents do not occur at any time; they can happen to anyone at any time. He also urged PLVs and other government institutions to spread awareness among the public that accidents can happen anywhere, and therefore, bike riders should wear helmets and car drivers should wear seat belts. Furthermore, if an accident occurs, nearby people should inform the police and assist in transporting the injured to the nearest hospital. The police do not make a witness of the person who takes the injured to the hospital. Nishant Kumar, PO, MACT, further stated that in road accident cases, investigators are required to submit a First Accident Report (FAR) to the Claims Tribunal within 48 hours of the accident, with a copy to be provided to the accident victims, the insurance company, and the JHALSA. Furthermore, investigators are required to submit a detailed accident report to the Claims Tribunal within 90 days of the accident, with a copy to be provided to the accident victims, the claimant, the driver, the owner, the insurance company, and the FJALSA. He also highlighted all the points related to the FJAL and discussed various MJAL firms and urged all firms to submit their reports in a timely manner, ensuring timely disposal of motor accident cases and timely disbursement of appropriate compensation to the victims.
CT SP Rajkumar Mehta praised the workshop and directed all police station in-charges to ensure that accident-related documents are submitted promptly to the relevant site. He also stated that if the documents are not submitted on time, the responsibility lies not only with the IO but also with the police station in-charge. He stated that road accidents occur regularly in the district, and that most of the victims who have lost their lives were breadwinners and were involved in accidents while driving at high speeds. Consequently, the Road Safety Department is unable to provide copies of the FIRs, or due to errors in the FIRs, the victims are unable to receive compensation from the state and central governments. Discussing the golden hour, he explained that the primary duty of humanity is to immediately transport the injured person to the nearest hospital, or trauma center, immediately after a road accident. He also stated that most accidents are caused by drunk driving or driving while talking on a mobile phone. He also explained that in any accident resulting in death, in hit-and-run cases, if the vehicle is unidentified, the central government provides 2 lakh rupees and the state government provides 1 lakh rupees.
