Driver acquitted in case of bike rider's death due to pickup collision


Uttarahkand/Nainital: The Judicial Magistrate and Second Additional Civil Judge-Junior Division Court of Nainital district has acquitted the driver of a pickup who caused the death of a bike rider by hitting a bike, of the charge of murder.

According to the story presented by the prosecution, on 29 November 2023, 54-year-old Shivraj Singh, son of late Bhupal Singh, resident of village Bachkande Post Syunani Tehsil Jaiti District Almora, was returning to his home from Haldwani on his bike number UK01B-4497. During this, at around 10 am, near Pahadpani, pickup number UK01CA-1510 coming from the opposite direction towards Haldwani allegedly hit his bike in the wrong direction with high speed and negligence.

After the incident, Shivraj was sent to the hospital by 108 emergency service, where the doctor declared him dead. In this case, action was demanded against the pickup driver Vivekananda Bhatt son of Laxmi Dutt Bhatt.

In the case, the police sent a charge sheet against the accused Vivekanand Bhatt to the court under sections 279 and 304A of the Indian Penal Code. The court took cognizance of this on 7 May 2024 and directed the accused to appear in court. The accused appeared in the court and applied for bail and said that he did not hit anyone. He has been falsely implicated.

The court of Judicial Magistrate and Second Additional Civil Judge-Junior Division Nainital Sneha Narang, after a thorough hearing of the case, found that the prosecution failed to prove the allegations beyond reasonable doubt. The court admitted that it could not be proved that on the day of the accident, the accused Vivekanand Bhatt was driving the vehicle that caused the accident or he drove the vehicle negligently, which caused the accident and Shivraj Singh died.

On this basis, the accused Vivekanand Bhatt was acquitted of the charges under sections 279 and 304A of the Indian Penal Code. Young advocate Jayant Nailwal pleaded on behalf of the defense.
