No Witness Produced in Three Years in Dowry Death Case; Accused Husband Avneesh Dubey Acquitted

In a major observation on prosecution lapses, a Ranchi court has acquitted Avneesh Kumar Dubey, who was facing serious charges of dowry death. The court stated that the prosecution could not present any witness despite repeated summons and warrants issued over three years.

The case relates to the mysterious death of Deepika Kumari in 2020. Her father, Jitendra Mirdha, had alleged in his statement that after her marriage in 2018, Avneesh and his sister Poonam Kumari used to harass Deepika for additional dowry. He suspected that Deepika was poisoned on 7 September 2020.

Following the investigation, Sukhdev Nagar Police found the allegations of dowry death prima facie true and filed a chargesheet. The court framed charges on 8 July 2022, and the trial formally began.

According to court records:

  • 20 July 2023: First summons issued to witnesses
  • 13 October 2023: Bailable warrants issued
  • 11 June 2024: Arrest warrants issued
  • Senior police officials were also notified to ensure witness presence

Despite all these steps, not a single witness appeared before the court. The court remarked that the continuous failure of the prosecution made it impossible to prove the charges.

Due to the complete absence of evidence, the court acquitted the accused, Avneesh Kumar Dubey.
