Ranchi: A division bench of Jharkhand High Court Chief Justice MS Ramachandra Rao and Justice Rajesh Shankar has lifted the ban on registration of sale and purchase of non-cultivated khas land in the state. This decision was given by the High Court last week. The High Court has cancelled the notification (1132/26.8.2015) of the Revenue, Registration and Land Reforms Department, which had banned the registration of non-cultivated khas land. The peasants across the state, whose land is in non-cultivated khas account, were troubled by this notification of the department. Not only this, the court has also said that according to this notification, all the orders passed by the Sub Registrar or the officials of the Registration Department will be considered cancelled. Kamal Kishore Son, the then secretary of the Revenue Department, had issued a notification on August 26, 2015 and ordered that registration of transfer deed is against public policy under the relevant section 22 'A' of the Registration Act 1908. After this order, the purchase and sale of Kaiser-e-Hind land, non-cultivated common land, forest land, government land acquired for other departments including forests, as well as non-cultivated khas land was banned in Jharkhand. Many people had filed a petition in the High Court against the order.
