Deoghar Mutation Dispute: High Court Disposes of Writ Petition, Directs Petitioner to Pursue Statutory Appeal

The Jharkhand High Court has refused to directly intervene in the high-profile Deoghar mutation dispute and has directed the petitioner to pursue the statutory appeal process. A single bench led by Justice Anand Sen observed that an effective statutory remedy—an appeal before the Land Reforms Deputy Collector (LRDC)—is available against the order passed by the Circle Officer.
The matter pertains to a writ petition filed by the Santhal Pahadia Seva Mandal. The petition challenged an order passed by the Deoghar Circle Officer in Mutation Case No. 04/2018-19.
During the hearing, the High Court clarified that the petitioner should first file an appeal before the LRDC. The Court directed that the LRDC decide the matter in accordance with the law, taking into consideration the judgment passed in the relevant civil suit.
Furthermore, the Court noted that the issues raised in the interim application related to a cause of action distinct from that of the main writ petition. Entertaining it would unnecessarily expand the scope of the writ petition. On these grounds, the High Court dismissed the interim application and disposed of the writ petition.
