Ban on removal of contract workers in Child Welfare Department

Uttarpradesh/Prayagraj: Allahabad High Court has banned the removal of two employees working on contract in the posts of District Program Assistant and District Program Coordinator in the Central Government's Matri Vandana Yojana. Both the employees are currently working in Firozabad. The court has ordered to continue paying salary to the employees and pay the outstanding salary. Also, a reply has been sought from the state government.

Justice Ajit Kumar has given this order on the petition of Ambika Prasad Pandey and another. The advocate of the petitioner said that the Matri Vandana Yojana was earlier run by the Health Department. In which the petitioner was appointed on contract to the posts of District Program Assistant and District Program Coordinator. Later this scheme was transferred to the Child Welfare and Nutrition Department. The petitioners were also accommodated on contract in the Child Welfare Department on the posts of Data Entry Operator and Financial Literacy Specialist.

On January 31, the Director of Child Welfare issued an order to appoint these two posts through outsourcing and it was also listed on the Gem portal. Whereas the Director himself in his order dated October 17, 2023 had ordered to accommodate the contract workers already working on both the above posts.

The state government said that the central government has directed appointments for the operation of the scheme. The court said that the central government has directed to run the scheme smoothly, it does not mean that the employees should be replaced. The court has banned the removal of employees from the post and has sought a reply from the state government.
