Ranchi: A division bench of the Jharkhand High Court comprising Justice S.N. Prasad and Justice A.K. Rai has overturned a 15-year-old decision related to Army-occupied land in Morabadi. The court said there are serious disputes over facts in the case, which should be decided by a civil court, not through a writ petition.
The bench set aside the 2009 single-judge order that had directed the Army to return 4.46 acres of land to the legal heir of the original owner.
The Enforcement Directorate (ED) informed the court that land documents submitted by petitioner Jayant Karnad were found to be forged. The ED claimed revenue records and mutation registers were fake, and forensic examination also confirmed tampering.
The land has been under Army possession since 1946. The ED also alleged that Jayant Karnad sold the same land to 13 people in 2019 despite it being under Army control. A probe under the PMLA is underway.
