🚨 Demand for Action Against Health Minister Under BNS Sections 13(1)(a) and 13(2)

Ranchi: Rafia Naz, a state spokesperson, has launched a sharp attack on Jharkhand Health Minister Mr. Irfan Ansari regarding the continuous deterioration of the state's health system and alleged constitutional violations. She expressed outrage over the Minister's recent statements, saying they are not only confusing the public but also raising serious questions about the Constitution, service rules, and the fundamental spirit of the law.

Violation of Constitution and Service Rules

Rafia Naz alleged that the dignity of the ministerial post and constitutional limits are being openly disregarded.

 * She accused the Health Minister of repeatedly claiming that he can provide jobs with a salary of ₹3 lakh per month or arrange desired postings, which is a direct violation of the constitutional framework and service rules.

 * She clarified that the law does not provide for any minister to directly offer a job or arrange appointments based on money or influence.

Demand for Criminal Proceedings Against the Health Minister

Rafia Naz demanded action against the Minister under the Bharatiya Nyaya Sanhita (BNS):

 * She stated that if a minister violates the Constitution and service rules in this manner, they are considered guilty of misuse of office under Section 13(1)(a) of the BNS.

 * She pointed out that under Section 13(2), they can face imprisonment from four to ten years and a fine, which applies equally to ministers, MLAs, and officials.

Questioning Promises vs. Ground Reality

The spokesperson questioned the disconnect between the Minister's statements and real-life incidents:

 * She asked why, if there is so much provision for giving jobs, positions were not provided to the families of the children who died due to negligence in road accidents.

 * Questioning Compensation: The Minister had spoken of giving ₹1 lakh in compensation from his salary; if that compensation was actually given, its details should be made public.

 * Silence on Rubika Paharia Murder: She cited the brutal murder of Rubika Paharia, calling the Minister's silence alarming, and demanded public disclosure of the compensation given to the Paharia family.

Deterioration of Ambulance and Basic Facilities

Rafia Naz accused the Health Minister of being busy with "reels and rhetoric," while the ground reality is extremely poor.

 * She stated that today, the common public is not even getting basic health facilities like ambulances in Jharkhand.

 * She referred to the Chaibasa incident, where a four-month-old baby died because an ambulance did not arrive on time, yet the Minister continued to debate the child's age insensitively.

 * She called such insensitive rhetoric shameful, regardless of whether the child was four days, four months, or four years old, accusing the current government of being disconnected from the ground reality and lacking human empathy.

Dire Situation in Rural and Tribal Areas

The spokesperson described the health system's status in the state's rural and tribal areas as "extremely dire":

 * People are forced to spend from their limited pockets for treatment; the Mukhyamantri Gram Bus Yojana is nowhere to be seen on the ground.

 * Tribal individuals are forced to carry their pregnant wives on their shoulders, moving from hospital to hospital.

 * Deaths are occurring in Gumla, Simdega, Chaibasa, Ranchi, and several other districts due to ambulances not arriving on time.

 * Incidents have been reported where operations were conducted under torchlight in operation theaters, and children and patients have died due to a lack of timely medical assistance.

 * She also mentioned that even nurses are not available for female prisoners in jails, and several people died simply because an ambulance could not be secured on time.

Serious Health Security Concerns

Rafia Naz also highlighted incidents that raise serious questions about health security:

 * Incidents of HIV-positive blood transfused to children suffering from Thalassemia.

 * The recovery of a large number of bottles during raids on illegal cough syrup dens in Jharkhand, indicating that illegal activities are rampant within the Health Department's domain.

Questioning Budget and Double Standards

 * She noted that the state's total health budget is approximately ₹7,427.50 crore, with an additional supplementary budget of ₹729 crore, yet, according to her assessment, not more than ten percent of the funds are being effectively utilized at the ground level.

 * Rafia Naz concluded that on one hand, the Minister talks about giving a job to a Muslim Ayush Doctor, and on the other, a Muslim girl doing yoga is called 'ang-pradarshan' (indecent exposure), which is a dangerous double standard against social harmony and constitutional values.

She concluded by saying that the people of Jharkhand need a responsible, sensitive, and strong health system, not reels, rhetoric, and empty promises.
