In a nearly nine-year-old dowry harassment case, the court has granted permission to the prosecution to re-examine the Investigating Officer (IO). The order was passed by the Judicial Magistrate–IX in connection with Ratu Police Station Case No. 07/17.
In this case, the victim’s husband Amit Kumar Sinha along with five others is facing trial. The prosecution had filed an application under Section 311 of the Code of Criminal Procedure, stating that the testimony of the Investigating Officer is essential in the interest of justice. The application also mentioned that due to unavoidable and inadvertent circumstances, the IO could not be examined earlier, as a result of which the prosecution’s case could not be presented in its entirety.
During the hearing, the defence opposed the plea, arguing that the prosecution was attempting to unnecessarily prolong the trial. However, after hearing arguments from both sides and examining the case records, the court observed that the testimony of the Investigating Officer is necessary to ensure a fair trial.
The court directed the prosecution to complete the examination of the Investigating Officer within only two fixed dates. The next date of hearing in the matter has been scheduled for 15 January 2026. The order also clarified that the testimony of the Investigating Officer will be recorded only after the statements of the accused are completed.
According to the allegations, the victim was married in the year 2012, during which her parents reportedly gave household items and jewellery worth around ₹15 lakh. Despite this, the in-laws allegedly subjected her to mental and physical harassment by taunting her over insufficient dowry. It has also been alleged that the in-laws demanded an additional ₹5 lakh in cash.
The latest order of the court is being considered significant for the prosecution, as it is expected to help place crucial evidence on record and bring greater clarity to the case.
