Delhi High Court Orders Patanjali to Withdraw ‘Misleading’ Chyawanprash Advertisement

 

New Delhi: The Delhi High Court has directed Baba Ramdev’s company, Patanjali Ayurved, to remove its recent advertisement that labels other companies’ chyawanprash products as “fake” or “deceptive.” Justice Tejas Karia observed that the advertisement attempts to tarnish the overall image of ayurvedic chyawanprash products in the market.

During the hearing, Justice Karia questioned Patanjali’s use of the term “fraud” for competing brands in its commercial. The court remarked that while Patanjali is free to promote its product as the best, it cannot discredit others by calling them fake. “The word ‘fraud’ carries a negative connotation. You are effectively saying that others are fake and that people are consuming fake products,” the judge said.

The order came in response to a petition filed by Dabur India, which alleged that Patanjali Ayurved’s advertising campaign was misleading and defamatory. Dabur argued that the campaign was aimed at discrediting other chyawanprash brands and confusing consumers into believing that Patanjali’s product was the only authentic ayurvedic chyawanprash available.

According to the petition, Patanjali’s advertisement claimed that its chyawanprash was made using more than 51 herbs, while in reality, it contains only 47. Dabur further alleged that traces of mercury were found in Patanjali’s product, making it potentially harmful, especially for children.

The court has now ordered Patanjali to withdraw the advertisement immediately and refrain from using any misleading or defamatory statements about competing products in the future.
