The court of Additional Judicial Commissioner-5, Civil Court Ranchi, has rejected the anticipatory bail petition of Rajiv Kumar Mishra alias Bittu Mishra in the case involving vandalism inside the police station and assault on police personnel. The court has directed the accused to surrender before the lower court.
The Case Background
As per the FIR lodged at Pandara OP on September 21:
- Bittu Mishra allegedly entered the police station along with over 100 supporters,
- indulged in vandalism,
- damaged government property and vehicles,
- destroyed important documents,
- and attacked the police personnel on duty.
A case was registered against him based on these allegations.
Prosecution’s Argument
The APP opposed the bail plea, stating that the incident was serious and that the accused played a direct role in the violence and destruction inside the police station. Hence, anticipatory bail should not be granted.
Defence’s Stand
The defence argued that:
- The accused was not present at the incident site.
- He was out of the state on the day of the incident.
- He has been falsely implicated.
However, after examining the case diary and available evidence, the court did not accept these arguments.
Court’s Order
After hearing both sides, the court ruled:
“There is no ground to grant anticipatory bail. The accused is directed to surrender before the lower court.”
